Who these terms are with

In these terms, “Ignite Drones”, “we” and “us” mean Ignite LLC. “You” means the person or business making the booking.

Who owns the footage, and what you can do with it

We own the copyright in every photo and video captured on your booking.

Once you have paid in full, you receive a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, edit, create derivative works from, publicly display, publicly perform, distribute, sell and sublicense those files, for any purpose, commercial or personal. No further payment, credit, attribution or approval is ever required, and the license cannot be taken back.

In practice that means you can do anything with the files an owner could: post them anywhere, run ads with them, edit them, sell them, hand them to an agency or editor, and reuse them for as long as you like.

We keep the copyright so we can maintain a small library of wide scenic shots, described below. Keeping it does not limit your license.

When your license starts

Your license takes effect when your payment is received in full.

Having the files does not by itself grant a license, including files handed over at the shoot. Until payment is received, any use of the footage is unauthorised.

What we keep, and what we never sell

We may use, license and sell wide scenic and landscape material captured on a flight, such as lake views, ridgelines and town views, including through our own stock library.

We will never license or sell to anyone else footage in which your home, buildings, project, family, staff or any other person is the subject.

We may show work from your booking in our own portfolio and marketing. If you would rather we did not, tell us in writing and we won’t.

Weddings, private events and private homes

For weddings, private events, and residential bookings where the home is the subject, exclusivity is included at no charge. We will not license, sell or publish any footage from that booking, including in our portfolio.

Exclusivity and full ownership

For any other booking you can ask for exclusivity, so that nothing from your shoot is licensed, sold or published by us. Exclusivity is priced separately and arranged by phone before the flight.

If you need to own the copyright outright, that requires a separate written assignment signed by us. It cannot be granted by ticking a box on this site.

Consent to record

Idaho law requires written consent before private property is targeted for aerial recording, and before a person is recorded for publication (Idaho Code § 21-213).

By booking, you consent to aerial photography and video recording of the property named in your booking, and of you and anyone you authorise to be present, for the purpose of producing, publishing and publicly sharing the footage. You confirm that you own the property or have the authority to give this consent.

Anyone else who may be present and recognisable must sign a short release before the flight, or will be kept unrecognisable in the footage. Tell us in advance if other people will be on site.

What is delivered

Bookings deliver raw, unedited files exactly as captured. No colour grading, cutting, stabilising, retouching or music is included, and none is implied.

Video is captured in 4K using a D-Log 10-bit profile, which is deliberately flat and ungraded so you can colour it yourself.

File counts shown on the site are what a typical shoot of that length produces. Weather, light, airspace and the property itself can move them in either direction.

Files are handed over the same day as the flight.

Weather and safety

Flights are cancelled or rescheduled whenever conditions make them unsafe or unlawful, including wind, precipitation, smoke, visibility and airspace restrictions.

Rescheduling for weather is free. You are never charged for a flight that did not happen.

The decision on whether conditions are safe to fly rests with the pilot.

Airspace and certification

We operate under a current FAA Part 107 Remote Pilot certificate.

Some locations sit in controlled or restricted airspace and require authorisation before a flight can legally happen. Where that applies, authorisation is requested in advance. If it is denied, the booking is cancelled at no charge.

Scheduling, travel and payment

Booked hours are time on site, which includes setup, battery changes and repositioning. They are not flight time.

Travel within 30 miles of Coeur d'Alene is included. Beyond that a single flat $75 trip fee applies and is shown before the booking is confirmed.

Nothing is charged at the time of booking. Payment is due once the work is delivered, unless agreed otherwise in writing. Payment in full is what starts your license.

A booking is not confirmed until we confirm it back to you.

Cancellation

Cancel any time before the flight and nothing is owed.

If the pilot arrives on site and the flight cannot go ahead for a reason within your control, such as no access, no permission or nobody to open a gate, the booking may be charged in full.

Limitation of liability

Our total liability for any booking is limited to the fees you paid for that booking.

How you agree to these terms

You accept these terms by ticking the booking terms box and the separate consent-to-record box before sending a booking request. A booking cannot be sent without both.

We record which version of these terms you accepted, the date and time, and the IP address the request came from.

When these terms change, the version date changes. Earlier versions stay available at the bottom of this page, and a booking is always governed by the version accepted when it was made.
